The functional separation is one of the new instruments of policy of regulation applied on the electronic communication market in the European Union. The key premise inducing the use of this instrument is the possibility of improvement of competitiveness of the market. The principal aim of this article is to estimate the legitimacy of this instrument for one of the segments of electronic market in Poland.
