STRESZCZENIE
W artykule przedstawiono analizę procesu sporu w wypadku aktualizacji wysokości opłaty rocznej płaconej przez użytkownika wieczystego. Autorka przedstawiła zarys pochodzenia prawa użytkowania wieczystego, a następnie określiła jego podstawowe cechy i znaczenie dla dochodów wybranych miast. Na tym tle dokonała analizy procesu aktualizacji wysokości opłaty rocznej w sensie teoretycznym, a następnie przeniosła swoje rozważania na grunt praktyczny. W badaniu wykorzystano dane statystyczne udostępniane przez GUS, sprawozdania Samorządowych Kolegiów Odwoławczych oraz stworzoną bazę spraw sądowych.

PERPETUAL USUFRUCT IN THE CONTEXT OF ANNUAL FEES UPDATING DISPUTE
Abstract
The article presents an analysis of the process of dispute in case of updating the annual fee paid by the perpetual user. The author outlined the origin of the right of perpetual usufruct, and then define its basic features and importance for the revenue in selected cities. Having this background the author analyzes the process of updating the annual fee in a theoretical sense, then she transfers it to the ground of practical considerations. The study is based on statistical data provided by the Central Statistical Office, the reports of Municipal Boards of Appeal and own database of court cases.
