STRESZCZENIE
Problematyka związana z własnością należy do fundamentalnych zagadnień ekonomii. Typ własności determinuje rodzaj systemu gospodarczego, a ochrona praw własności jego efektywność, lecz zagadnienia dotyczące własności są coraz rzadziej tematem rozważań w ramach tej nauki społecznej. Wydaje się jednak, że nie wszystkie kwestie zostały rozstrzygnięte i uporządkowane. Dodatkowo współczesne procesy zachodzące w gospodarce światowej powodują konieczność ponownego przeanalizowania i zaktualizowania tych zagadnień. Celem artykułu jest zdefiniowanie, a następnie uplasowanie własności i jej ochrony (rozumianej jako miara efektywności systemu gospodarczego) w ramach zagadnień dotyczących roli państwa w gospodarce i szeroko rozumianej wolności gospodarczej. Skupiono się również na przedstawieniu podstaw prawnych dotyczących ochrony własności oraz przedstawiono i opisano powszechnie znane i akceptowane miary ochrony praw własności.

THE ROLE OF STATE IN THE OWNERSHIP PROTECTION
Abstract
The issues connected with the ownership are crucial for economics. The type of ownership determines the type of economic system and the ownership protection influences its efficiency. However these issues are rarely present in nowadays considerations within the social studies. In addition, the contemporary processes which take place in global economy cause the necessity of renewed analysis and updating of these issues. The main goal of this article is to define and reside the ownership and ownership protection (understood as the measure of economic system efficiency) within the scope of issues connected with the role ofstate and economic freedom. The article also focuses on describing the legal background of ownership protection and the well-known and widely accepted measures of ownership protection.
