Streszczenie:
Celem referatu jest przeprowadzenie oceny roli ryzyka regulacyjnego w koncepcji responsive regulation. Zastosowaną metodą badania jest analiza najważniejszych publikacji J. Braithwaite’a, J. Blacka i R. Baldwina. Wykazano, że dominuje fragmentaryczne podejście do ryzyka regulacyjnego, przywiązuje się dużą wagę do budowania relacji między regulatorem a podmiotami regulowanymi, preferuje się jakościowy pomiar ryzyka. Behawioralne cechy omawianej koncepcji, a zwłaszcza model piramidy wdrożenia regulacji, może być przydatny w doskonaleniu krajowych procesów legislacyjnych.

RISK REGULATION IN THE CONCEPTION RESPONSIVE REGULATION
Abstract:
This paper is dedicated to assessing the role of regulatory risk presented by Responsive Regulation concept. The author analyzes the most important publications in this field (J. Braithwaite, J. Black, R. Baldwin). The main result of this review underlines the domination of fragmented approach to the regulatory risk and it emphasizes the necessity to build the relationships between the regulators and the regulated entities. The preferred attitude should be focused on the qualitative risk measurement. Behavioral characteristics of this concept may be useful in improving national legislative processes. Particularly the pyramid model of regulatory implementation could be appropriate for this purpose
